Paolella Discusses Garland Nomination in New York Law Journal

Reich & Paolella partner Christopher Paolella was among several New York litigators and appellate experts quoted by the New York Law Journal on nomination of D.C. Court of Appeals Judge Merrick Garland to the U.S. Supreme Court.

Judge Garland would come “to the Court with more of the judicial world view of Justice [Stephen] Breyer than a Justice Scalia,” Paolella said. He would “move the center of gravity” on the Court to the left of center if confirmed to replace Justice Antonin Scalia, “who was both an intellectual giant and the rock on which the court’s center-right coalition has been built in the last 25 years.”

But Paolella added that Judge Garland’s ideological moderation could appeal to Senate Republicans facing an uncertain presidential election: “There are some Republicans who would say, ‘This is the least bad nominee we can get from this administration.'”  Judge Garland’s age, he said, could be viewed as a “built-in term limit,” as well as bringing more judicial experience to the Court.

Reich & Paolella is a New York-based law firm that devotes its practice exclusively to litigation and advocacy, focusing on complex commercial litigation, appeals and critical motions, and white collar defense and investigations. The firm has an active Supreme Court practice.
