Paolella Selected as 2016 “Super Lawyer”

Reich & Paolella partner Christopher Paolella has been selected to the 2016 New York Super Lawyers list in the fields of appellate and business litigation. This is the third consecutive year that Paolella has been selected for this honor. Paolella Talks Amtrak on Bloomberg Law

Reich & Paolella partner Christopher Paolella appeared on the Bloomberg Law radio program to discuss the D.C. Circuit’s recent decision in Association of American Railroads v. Amtrak, which struck down Amtrak’s power to regulate its private rail competitors as unconstitutional. Reich & Paolella filed an amicus brief in the case on behalf of Emory Law School Professor Alexander Volokh, an administrative law scholar who has written extensively about the constitutional constraints on hybrid public-private ventures like Amtrak. The D.C. Circuit’s ruling agreed with Professor Volokh’s position that a law empowering a market participant to regulate its competitors violates due process, regardless of whether the regulating entity is public or private.

Paolella Discusses Garland Nomination in New York Law Journal

Reich & Paolella partner Christopher Paolella was among several New York litigators and appellate experts quoted by the New York Law Journal on nomination of D.C. Court of Appeals Judge Merrick Garland to the U.S. Supreme Court.

Judge Garland would come “to the Court with more of the judicial world view of Justice [Stephen] Breyer than a Justice Scalia,” Paolella said. He would “move the center of gravity” on the Court to the left of center if confirmed to replace Justice Antonin Scalia, “who was both an intellectual giant and the rock on which the court’s center-right coalition has been built in the last 25 years.”

But Paolella added that Judge Garland’s ideological moderation could appeal to Senate Republicans facing an uncertain presidential election: “There are some Republicans who would say, ‘This is the least bad nominee we can get from this administration.'”  Judge Garland’s age, he said, could be viewed as a “built-in term limit,” as well as bringing more judicial experience to the Court.
